Two emails spill the beans - Interestingly the government never acknowledges that our call is for stronger terms of reference as well as a longer Royal Commission. Scott Morrison was the number one opponent of any inquiry into the banks. He knows exactly what has been going on. We know that ..... and he knows that we know. It is a shock how blatant the political support for bankers stealing from clients and the nation is. Last weekend I had the honour of assisting the launch of the Australian Yellow Vest movement. It was a pleasure meeting you in August after 35 people came to Parliament House to expose finance sector crimes that have not been touched by the Royal Commission. You very kindly assisted us and one week after we had meetings with Matt Comyn - on the 11th of October at Parliament House - Mr Comyn began paying compensation.
 
I didn't ask you to intervene on my behalf with my own issue because I am arranging settlement with the bank in the very near future on mutually satisfactory terms.
 
The reason I am writing to you now is to give you a bit of a tip. Many people want to see the Banking Royal Commission strengthened with more powers and more time. You now have an opportunity to do just that. As previously advised - we feel that Commissioner Hayne should be joined by two or three independent Commissioners. If he only signed up for one year then he could step down after Round 7 and hand over to the new team in an orderly fashion.
 
I spoke with Senior Counsel Rowena Orr this week. She had been very professionally surgically dissecting CBA CEO Matt Comyn in the RC dock. The previous CEO Ian Narev has been dropped under the bus by Comyn and Chair Catherine Livingstone. I suggested to Ms Orr that she should have Narev called in for questioning. She told me there wasn't enough time. I told her that's easily fixed - the RC must be extended -  she said "it's not up to me."
 
It is up to you.
 
There is an element of urgency now. It has been known for quite a while that a conflict of interest exists. The Royal Commission has tried to cover up this conflict. It involves fraudulent Federal court orders and judgments being used to steal the assets of a businessman and his family. The course of events led to the death of the businessman and his family being left destitute. The judiciary was involved in the coverup and the subsequent serious miscarriage of justice. Mr Hayne knows very well about cases like this and he has steadfastly avoided exposing them in the Royal Commission. The Royal Commission has in effect censored submissions that point out these conflicts and failings.
 
The banks cannot get away with predatory unconscionable conduct without a complicit legal and judicial apparatus. Commissioner Hayne deliberately ignores looking at this - just as he has avoided the liquidators and receivers. He can ask for more powerful terms but he also says it is up to you.
 
By the way - here is another little known fact that Hayne also avoids investigating. The banks routinely indemnify the lawyers and liquidators that do their dirty work. If those henchmen are protected and remain unaccountable of course they will lie, cheat and bully to strip the assets from hard working bank customers.
 
The House Economics Committee knows how it feels when a bank targets someone. BRN has supplied the Committee with specific cases of criminal misconduct. The CEOs are now being watched to see that legacy cases are being properly resolved and the victims remediated. Transparency and good faith negotiations are the order of the day in this new environment which has in large part been created by the Royal Commission that you repeatedly said was not necessary. And this progress is despite your government imposed limitations on the Commission.
 
The perception is that government - both Labor and Liberal - have been protecting the banks for decades. You have said that you knew about the banks' crimes all along so there was no need for a Royal Commission.
 
Both major parties have taken significant donations from the banks. Many politicians have enjoyed the attentions of bankers. It's a bad look. It is not surprising that the calls for a Federal Corruption body are growing stronger right now. Reforming the banks will be painful but it needs doing regardless. I have seen what banks are capable of. The first thing I clarified with you back in August was that you knew the banks were involved in criminal activity. They abuse their power. It is quite likely that you are worried that they could cause harm to the economy in various ways. Do not let those fears stop you. Great statesmen are born during great challenges. Take the banks on and reform the system. Now is the time.
 
Lives are being destroyed. People are being robbed every day. Upper echelon bankers don't just appear to be leading Mafia style operations they actually are engaged in criminal conduct. Executives will be found guilty and significant penalties will be applied. How will you look then?
 
Sorry to be so blunt but I am giving you a truth bomb just like I did when we first met. You might not like what I'm saying but that doesn't mean it's not valid information that you can use for the benefit of the party and more importantly for the country.
 
Scott - pretending to drive around the country on a bus wearing a baseball cap will not cut it for you. The country is crying out for a Statesman not a drinking buddy. We need leadership that is bold, trustworthy and effective.
 
You never know how things pan out in politics. NSW is a good example - an off the cuff jab in Parliament and a few weeks later a political leader is history - not even welcome by his own party to remain in parliament as a backbencher.
 
The miscarriage of justice I refer to above will be newsworthy and call into question the judgement of the government in opposing and handicapping the Royal Commission. I really can't see the LNP winning next year if things escalate.
 
Losing Wentworth is a shocker for the party. I don't think any seats are safe now. It will be impossible for your marginal seat candidates to hold on. Frankly - the only thing the LNP has going for it right now is Kevin Rudd's second coming stroke of genius demand which has cemented the ALP leader into place.

Thank you for your email dated 22 November 2018 to the Prime Minister, the Hon Scott Morrison MP, regarding the Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry. The Prime Minister has asked me to respond on his behalf. I apologise for the delay in responding.

The Royal Commission has proved valuable in shining a light publicly on the misconduct of some financial institutions. Like all Royal Commissions, it has been conducted independently from the Commonwealth Government. The Commissioner, the Hon Kenneth Hayne AC QC, is responsible for establishing his own processes for conducting the inquiry. The Government respects the independence of the Royal Commission.

The Prime Minister and the Treasurer, the Hon Josh Frydenberg MP, have said publicly on a number of occasions that the Government will provide an extension if Commissioner Hayne requires further time. To date, the Commissioner has not requested an extension.

We look forward to receiving Commissioner Hayne’s insights and recommendations. The Government is committed to taking action in response to the final report to improve the integrity of the financial sector.

BRN Comments

Steve Irons was dropped into it by the PM. His response is not a response. No reference to any main issues raised in the email. The overriding concern of the PM is to protect the bankers from meaningful reforms that would serve the people's interests. Last week the BRN speech at the Yellow Vest launch in Sydney exposed the whole box and dice - link below.

Now is the time to get active. Learn how we have been done over for decades by both major parties and push for change. It's policy that counts not parties or politicians. Only support pollies that will support policies that are good for you and your country.

Right now we are seeing MPs & Senators quitting the LNP. Julia Banks (Chisholm - Vic) is now on the crossbench as an independent. These three have just abandoned ship and won't be running at the next election: Kellie O'Dwyer (Higgins - Vic), Michael Keenan (Stirling - WA), Nigel Scullion (NT Senate). There will be more in the next two weeks.

For Election 2019 - Let’s hope there are some good independents who commit to new ideas and innovative policies - regardless what the elite want. Also perhaps the new political landscape will see LNP and ALP candidates make their support for you much clearer ….. perhaps by seeing the writing on the wall and choosing independence & honour over unemployment & shame.
